Section 297 of the Environment Protection Act 2019 (EP Act) includes provision for the NT EPA to terminate assessments under the former Environmental Assessment Act 1982 (EA Act) if:
(a) an assessment process commenced in relation to a proposed action under the EA Act before the commencement (of the EP Act on 28 June 2020); and
(b) the proponent had taken no steps or only limited steps in the assessment process before 28 June 2020.
On 29 August 2022, the NT EPA terminated ten environmental impact assessment processes submitted under the former EA Act. The processes were terminated due to the passage of time since the assessment process commenced and in accordance with the provisions of section 297 under the EP Act.
